2. Definitions
“We”, “us” and “our” means CIM RETAIL LTD. “You” and “your” means the person accessing this website or placing an order. “Products” means the goods advertised for sale on this website, including scented and personalised candles.
3. Eligibility and use of the website
You must be at least 18 years old to place an order. You agree to use this website only for lawful purposes and not to misuse it in any way that could damage, disable or impair the site or interfere with any other party’s use of it.
4. Orders and formation of contract
Your order is an offer to buy from us. After placing an order you will receive an acknowledgement email confirming we have received it; this does not mean your order has been accepted. A contract between you and us is formed only when we send you an email confirming that the Products have been dispatched. We reserve the right to refuse or cancel any order before dispatch.
5. Pricing and payment
All prices are shown in pounds sterling (GBP) and include VAT where applicable. We take all reasonable care to ensure prices are correct; if we discover an error in the price of Products you have ordered we will inform you and give you the option to continue at the correct price or cancel. Payment is taken at the time of order through our secure payment providers. We do not store full card details.
6. Products and personalisation
We make every effort to display the colours, scents and details of our Products accurately, but we cannot guarantee that your device’s display accurately reflects the actual product. As our candles are handmade, slight variations are normal and are not defects. Where you order a personalised or bespoke product, you are responsible for ensuring that any text, spelling and customisation details you supply are correct.
7. Delivery
We will deliver the Products to the address you provide at checkout. Delivery timescales are estimates only and are not guaranteed. Risk in the Products passes to you on delivery. Please ensure your delivery details are accurate, as we are not responsible for orders delayed or lost due to incorrect address information.
8. Cancellations, returns and refunds
Under the Consumer Contracts Regulations 2013 you may have the right to cancel a standard order within 14 days of receiving the Products and return them for a refund. Returned items must be unused and in their original condition and packaging. Please note that personalised, bespoke or made-to-order candles are exempt from the standard 14-day cancellation right, except where they are faulty. 9. Safety and use of candles
Please follow the safety instructions supplied with your candle. Never leave a burning candle unattended, keep away from children, pets and flammable materials, and place on a heat-resistant surface. We are not liable for damage or injury resulting from improper use of our Products.
10. Intellectual property
All content on this website, including text, images, logos and designs, is owned by or licensed to CIM RETAIL LTD and is protected by intellectual property laws. You may not reproduce or use any content without our prior written permission.
11. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect or consequential loss arising from your use of this website or the Products. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded by law.
12. Privacy and cookies
We process your personal data in accordance with our Privacy Policy and Cookie Policy, which form part of these Terms.
13. Governing law
These Terms are governed by the laws of England & Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England & Wales.
